Terms Of Service
Effective Date: 24 November 2025
Welcome to Host2Media! These Terms of Service (TOS) govern your access to and use of Host2Media's services. By using our services, you agree to be bound by these terms. If you do not agree, please discontinue use immediately
1- Introduction
This agreement outlines the terms and conditions for using the services provided by Host2Media, including but not limited to web hosting, domain registration, and email hosting. These terms are legally binding and designed to protect both the company and the clients.
1A- Automatic Acceptance Through Use
By accessing, using, purchasing, renewing, or interacting with any Host2Media service, system, website, control panel, email service, DNS service, support channel, or hosted infrastructure, the Client irrevocably agrees to be bound by these Terms and Conditions in full, without exception.
Use of the services constitutes full legal acceptance of all clauses contained in these Terms, regardless of whether the Client has read them, reviewed them, understood them, or formally acknowledged them.
- The Client’s continued use of the services is deemed ongoing acceptance
- No signature or explicit consent is required for enforceability
- All updates take immediate effect upon publication on the Host2Media website
- Failure to discontinue service use constitutes automatic acceptance
- All employees, developers, consultants, or third parties acting on behalf of the Client are bound by these Terms
Any claim of “not reading,” “not seeing,” “not knowing,” or “not accepting” these Terms is expressly invalid. Use equals acceptance. Continued use equals continued acceptance. This rule applies universally and without limitation.
1B- Continued Payment Equals Acceptance
Any payment, renewal, subscription continuation, invoice settlement, or authorization of automatic billing constitutes irrevocable acceptance of these Terms and all future amendments.
The act of paying for Host2Media services—whether manually, automatically, partially, or on behalf of a third party—legally affirms the Client’s full acceptance of all Terms, regardless of any expressed disagreement or objection.
- Payments made by employees, partners, developers, or agents bind the Client
- Payments processed through auto-renewal bind the Client
- Any renewal—intentional or unintentional—constitutes acceptance of all Terms
1C- Third-Party Delegation Acceptance
Any access, usage, login, configuration, payment, or interaction with Host2Media services performed by a third party acting on behalf of the Client constitutes full and binding acceptance of these Terms by the Client.
- Developers, designers, IT staff, freelancers, and agencies
- Employees, partners, interns, or subcontractors
- Automated systems or scripts initiated by the Client
The Client is fully liable for all actions performed by any delegated individual or entity, with no exceptions. Host2Media bears no responsibility for unauthorized delegation, misconfiguration, negligence, or misuse.
1D- Retroactive Acceptance
These Terms apply retroactively to all past usage, services, interactions, and data hosted since the Client’s first use of any Host2Media service.
Continued use after any update constitutes immediate and retroactive acceptance of both the current version and all previous versions of these Terms, without limitation.
- Past invoices, past hosting periods, and past activity are fully covered
- No Client may claim older Terms apply unless explicitly stated in writing
- Retroactive enforcement applies to all legal disputes and violations
1E- Non-Readability Does Not Void Terms
Failure to read, access, review, or understand these Terms does not exempt the Client from legal obligations or enforcement.
Claims such as "I did not read the Terms," "I did not see the Terms," "I do not agree," or "I was not aware" are expressly invalid and carry no legal weight.
These Terms remain fully enforceable regardless of the Client’s level of knowledge, comprehension, or awareness.
1F- No Opt-Out Possible
The Client cannot opt out, partially accept, selectively accept, or reject any portion of these Terms. Acceptance is universal, indivisible, and mandatory for all service usage.
- No clause may be refused, excluded, or modified by the Client
- Continued use automatically reaffirms full acceptance
- Disagreement must be resolved solely by terminating service
Any attempt to alter, negotiate, override, or partially reject these Terms is invalid. The only alternative to full acceptance is the cessation of use.
1G- Client Responsibility for Account Security & Unauthorized Access
The Client is solely responsible for maintaining the confidentiality, security, and access control of all account credentials, including but not limited to: cPanel, email accounts, FTP access, SSH keys, billing accounts, API keys, and authentication methods.
- All activity performed through the Client’s credentials is presumed authorized
- Host2Media bears no liability for unauthorized access resulting from weak passwords, credential sharing, malware, phishing, employee actions, or negligence
- Password resets, logins, file uploads, and configuration changes are binding on the Client
Any compromise or unauthorized access is the sole responsibility of the Client. Host2Media is not required to investigate, remedy, or compensate for incidents arising from the Client’s failure to secure their account.
1H- Binding Nature of Digital Records, Logs, and IP Evidence
Host2Media’s digital system logs—including access logs, IP logs, authentication logs, timestamps, file modifications, resource usage logs, support logs, and automated system events—constitute final, authoritative, and binding evidence in all disputes.
- Logs shall be used to establish responsibility, authorization, and activity
- All logs are presumed accurate unless proven otherwise by a qualified digital forensics expert
- The Client bears all costs of any forensic challenge or investigation
The Client agrees that Host2Media’s logs take precedence over all external claims, screenshots, verbal statements, or internal client records.
1I- Presumption of Client Authorization for All Actions
All actions performed on any Host2Media service—whether through client login, API interaction, email request, support communication, automated process, or third-party access—are conclusively presumed to be authorized by the Client.
- Requests made from the Client’s registered email address are binding
- Actions performed from known devices, IPs, or prior access patterns are binding
- Actions by developers, employees, or contractors are binding on the Client
Host2Media is not required to verify the identity, intention, or authority of any individual using the Client’s credentials or contacting support from the Client’s registered communication channels.

No hosting service can guarantee business success, customer acquisition, or specific performance metrics. The Client assumes full responsibility for their use of the services and the outcomes achieved.

The Client bears sole responsibility for updating their applications and frameworks to maintain compatibility. Host2Media shall not be liable for any disruption, downtime, or data loss resulting from technology evolution.
84- Economic Sustainability & Pricing
To ensure long-term service sustainability:
- All pricing is subject to annual review and potential adjustment
- Existing clients receive 30-day notice of price changes
- Infrastructure costs, currency fluctuations, and regulatory changes may necessitate pricing updates
- Grandfathered pricing may be offered but is not guaranteed
Continued use of services after price change notifications constitutes acceptance of new pricing. No historical pricing is guaranteed in perpetuity.
Price adjustments do not entitle the Client to refunds, penalties, credits, or early termination exemptions. Currency fluctuations, supplier increases, licensing adjustments, or economic conditions may trigger immediate changes. Client acknowledges that historical pricing has no contractual permanence.

Service Level Agreement (SLA)
Service Level Agreement (SLA)
This Service Level Agreement ("SLA") is a non-contractual, descriptive overview of Host2Media’s operational objectives for Enterprise-level services. It does not create any financial, contractual, or performance guarantees. This SLA applies only to Clients who have explicitly purchased Enterprise services; Standard plans remain best-effort.
1. Nature of This SLA
This SLA is informational only. It is not a warranty, guarantee, binding commitment, or service contract. All remedies, liability limitations, and refund prohibitions in the Host2Media Terms of Service take precedence.
2. Service Availability Objective
Host2Media operates with the internal operational objective of achieving:
- 99.95% Service Availability per calendar month
This is a target, not a guarantee. It does not create any right to compensation, service credits, penalties, or refunds.
3. Definitions (Informational Only)
- Service Availability: The percentage of time the service is reachable at the network edge.
- Downtime: A period where the service cannot be reached due to factors within Host2Media’s infrastructure.
4. SLA Exclusions
The following do not count toward Downtime:
- Scheduled or emergency maintenance
- DDoS attacks or malicious traffic
- Client-side software or plugin issues
- DNS errors, domain expiration, or propagation delays
- Exceeded resource limits or fair-use violations
- Force majeure, sanctions, geopolitical events
- Security incidents caused by weak passwords or malware
- Suspensions or terminations for policy violations
- Technology deprecations and platform upgrades
5. Maintenance Windows
Maintenance may affect availability. Host2Media may conduct scheduled or emergency maintenance at any time. Maintenance windows are excluded from downtime calculations.
6. No Financial Credits or Compensation
This SLA provides no form of monetary compensation, service credits, liquidated damages, or financial remedy of any kind. The Service Availability target is a good-faith operational benchmark only.
7. Incident Reporting Procedure (Non-Contractual)
Clients may report suspected downtime or service issues to Host2Media support. Host2Media will investigate on a commercially reasonable basis.
This reporting process does not create any entitlement to compensation, credits, or guaranteed resolution timeframes.
8. Sole and Exclusive Framework
The remedies, limitations of liability, and termination rights outlined in the Host2Media Terms of Service supersede this SLA. This SLA creates no additional warranties, commitments, or obligations beyond those expressly stated in the Terms of Service.
9. Modifications
Host2Media may update this SLA at any time without notice. Continued use of services constitutes acceptance.
Master Service Agreement (MSA)
Master Service Agreement (MSA)
This Master Service Agreement ("MSA") governs the overall commercial relationship between Host2Media ("Provider") and the Client identified in the applicable Service Order Form ("Client"). This MSA is intended for agencies, enterprises, and business customers who enter into structured, recurring or custom service arrangements with Host2Media.
1. Hierarchy of Documents
The relationship between Host2Media and the Client is governed by the following documents, which together form the "Agreement":
- This Master Service Agreement (MSA);
- The applicable Service Order Form(s) (SOF) describing specific services and pricing;
- Host2Media's Terms of Service, Acceptable Use Policy, Abuse Policy, Privacy Policy, and related public policies as published on the Host2Media website.
In the event of any conflict, the document providing the most restrictive limitation of liability and the broadest protection for Host2Media shall prevail, unless expressly stated otherwise in a written, signed amendment.
2. Scope of Services
Host2Media provides hosting, infrastructure, related internet services, advisory, and optional managed services as described in the relevant SOF. No service, feature, or performance level is deemed included unless it is explicitly referenced in an active SOF or official Host2Media documentation.
3. Term and Renewal
This MSA becomes effective on the date of first execution by the Client or first use of services and remains in effect for as long as one or more SOFs are active. Individual SOFs define their own initial term and renewal cycles. Unless otherwise specified, services renew automatically under the same terms and billing frequency until terminated in accordance with this Agreement.
4. Fees, Billing, and Payment
Fees for services are specified in the applicable SOF or Host2Media price lists. Unless otherwise agreed in writing:
- All fees are due in advance of the service period.
- All payments are strictly non-refundable once services are provisioned.
- Late or unpaid invoices may result in suspension or termination.
- The Client is responsible for all applicable taxes, duties, and charges.
Any chargeback, reversal, or dispute of payment constitutes a material breach and may trigger immediate suspension, termination, and the application of liquidated damages and collection costs as outlined in the Terms of Service.
5. Client Responsibilities
The Client is solely responsible for:
- Compliance with all applicable laws, regulations, and sanctions.
- The content, legality, and security of all data hosted on Host2Media infrastructure.
- Maintaining up-to-date backups, unless a managed backup service is expressly purchased.
- Managing and securing user accounts, passwords, and access credentials.
- Ensuring all employees, developers, contractors, and end-users comply with Host2Media policies.
6. Data Protection and Privacy
Host2Media will implement reasonable technical and organizational measures to protect infrastructure and hosted data as described in its Security Policy. The Client remains responsible for data classification, regional regulatory analysis, and any required Data Processing Agreements (DPA). Nothing in this MSA submits Host2Media to foreign jurisdiction or expands its liability beyond the Terms of Service.
7. Intellectual Property
All software, systems, tools, documentation, and platforms provided by Host2Media remain the exclusive property of Host2Media or its licensors. The Client receives a limited, non-transferable, revocable right to use the services solely for their internal business purposes in accordance with this Agreement. The Client grants Host2Media a limited license to host, transmit, and process Client content as necessary to provide the services.
8. Support and Service Levels
Support is provided in accordance with Host2Media's Support Policy and, if applicable, any Enterprise SLA explicitly purchased by the Client. Standard plans receive best-effort support without response-time guarantees. No minimum service level or recovery timeframe is guaranteed unless expressly defined in a signed SOF and/or SLA.
9. Suspension and Termination
Host2Media may suspend or terminate services in accordance with the Terms of Service, including but not limited to:
- Non-payment or repeated late payment.
- Violations of the Acceptable Use Policy, Abuse Policy, or applicable laws.
- Sanctions-related or regulatory concerns.
- Security risks, abuse complaints, or platform integrity issues.
Unless explicitly agreed otherwise in a signed addendum, no refunds are owed for terminated services, and Host2Media may delete data after applicable retention periods or immediately in case of severe abuse or legal risk.
10. Limitation of Liability
Host2Media's aggregate liability under this MSA, any SOF, and any related policies is strictly limited to the amount paid by the Client to Host2Media for the affected service in the thirty (30) days immediately preceding the event giving rise to the claim. Host2Media shall not be liable for any indirect, incidental, consequential, punitive, or special damages, including loss of profits, revenue, data, or business opportunities.
11. Indemnification
The Client shall indemnify, defend, and hold harmless Host2Media, its officers, employees, and affiliates from any claims, damages, losses, costs, and expenses (including legal fees) arising out of:
- Client content or activities hosted on Host2Media infrastructure.
- Violations of this Agreement or Host2Media policies by the Client or its users.
- Regulatory or sanctions-related investigations triggered by Client activity.
12. Confidentiality
Both parties agree to treat non-public information received from the other party as confidential and to use it solely for the purpose of performing this Agreement. Confidentiality obligations do not apply to information that is public, independently developed, or legally required to be disclosed.
13. Compliance and Sanctions
The Client agrees to comply with all applicable Lebanese laws and international sanctions frameworks referenced in Host2Media's Terms of Service. Host2Media reserves the right to suspend or terminate services immediately where continued service may pose sanctions, legal, or security risks. The Client bears full responsibility for its own compliance posture.
14. Governing Law and Dispute Resolution
This MSA is governed exclusively by the laws of the Lebanese Republic. Disputes shall be resolved exclusively before the competent courts of Beirut, Lebanon, as further specified in Host2Media's Terms of Service.
15. Amendments
Any amendments or modifications to this MSA must be made in writing and signed by both parties. Host2Media may update its public policies and Terms of Service from time to time; continued use of the services constitutes acceptance of such updates.
Service Order Form (SOF)
Service Order Form (SOF)
This Service Order Form ("SOF") is an integral part of the Agreement between Host2Media and the Client. It describes the specific services, plans, pricing, and commercial details agreed upon for a particular subscription or project. Each executed SOF is subject to the Master Service Agreement (MSA), the Terms of Service, and all applicable Host2Media policies.
1. Purpose of the SOF
The SOF documents the concrete services being purchased, including hosting packages, resource allocations, support tiers, optional SLA coverage, add-ons, and any custom work. It ensures both parties share a clear written understanding of what is included, how it is billed, and when it begins.
2. Typical Information Included
A standard SOF may include, without limitation, the following details:
- Client legal name, company details, and primary contact information.
- Service type (e.g., shared hosting, reseller, VPS, dedicated, managed service).
- Plan name, specifications, and included resources (disk, bandwidth, email, etc.).
- Service location or datacenter region, if applicable.
- Billing frequency (monthly, quarterly, annually, or custom).
- Setup fees, one-time project fees, or migration fees, if applicable.
- Optional Enterprise SLA or premium support level, if purchased.
- Contract start date, renewal date, and initial committed term (if any).
- Special conditions, restrictions, or negotiated terms explicitly agreed in writing.
3. Binding Effect
By signing or electronically approving an SOF, the Client confirms that they have reviewed and accepted:
- The specific services and limitations stated in the SOF.
- The applicable pricing, fees, and billing cycle.
- The Master Service Agreement (if applicable).
- The Host2Media Terms of Service and all related policies.
In case of discrepancy between a marketing description and the SOF, the SOF controls. In case of discrepancy between the SOF and the MSA or Terms of Service, the document providing the most protective limitation of liability and legal shield for Host2Media shall prevail unless expressly stated otherwise in a signed amendment.
4. Changes, Upgrades, and Downgrades
Modifications to services originally defined in an SOF (such as upgrades, downgrades, or add-ons) may be:
- Captured in a new SOF referencing the prior one; or
- Documented through written confirmation from Host2Media and accepted by the Client via email or portal approval.
Any change that affects pricing, service scope, or SLA coverage should be considered effective upon written confirmation by Host2Media, even if a formal updated SOF is issued at a later time.
5. Term and Renewal under SOF
Each SOF may define its own initial term and renewal conditions. Unless explicitly stated otherwise, services renew automatically under the same terms and billing frequency described in the SOF. The Client is responsible for requesting cancellations or non-renewals in accordance with the Terms of Service and applicable notice requirements.
6. Non-Refundability
Unless otherwise specified in writing within the SOF, all fees listed in the SOF are non-refundable once the services are provisioned or work has commenced. This applies to setup fees, project fees, and recurring service charges.
7. Example SOF Structure
For illustration, a typical SOF layout may resemble the following structure:
- Client Information: Name, company, address, email, phone.
- Service Package: Plan name, resources, location, add-ons.
- Billing Terms: Setup fee, recurring fee, billing cycle, currency.
- SLA / Support Level: Standard, Premium, or Enterprise (if applicable).
- Initial Term: Start date, renewal pattern, minimum commitment (if any).
- Special Conditions: Any negotiated deviations approved by Host2Media.
- Signatures / Approvals: Authorized representatives of both parties.
8. Electronic Approval
Host2Media may accept SOFs approved through electronic signatures, secure client area confirmations, ticket confirmations, or other verifiable digital methods. Such approvals carry the same legal validity as a handwritten signature, subject to applicable Lebanese law.
9. Relationship to Other Documents
The SOF does not replace or override the Terms of Service, MSA, or other policies, but works in conjunction with them. Services ordered via the SOF remain fully subject to Host2Media's legal framework, including limitations of liability, sanctions compliance, and termination rights.
